1. Personal Data

“Diskret” Furniture has the right to collect and use information about its Clients when they fill out an order form. The information through which the Client can be identified may include first name, middle name, last name, address, occupation, gender, age group, telephone number, email address, and any other information that the Client enters or provides when making purchase requests, ordering, receiving, or using the services provided by “Diskret” Furniture, participating in promotions, raffles, and contests, filling out survey cards, questionnaires, forms, and others.

2. Processing of Client Information

2.1. “Diskret” Furniture takes due care and is responsible for protecting Client information that has become known in connection with the purchase and sale of goods and the provision of other services through www.diskret-bg.com – subject to these General Terms and Conditions, except in cases of force majeure, accidental events, or malicious acts by third parties.
2.2. In the order forms completed by the Client, “Diskret” Furniture designates whether the provision of data is mandatory or voluntary. By agreeing to these General Terms and Conditions, the Client consents to the processing of their information as stipulated herein.
2.3. The restrictions under 7.2.1. do not apply if the Client or persons under their control have committed malicious actions under these General Terms and Conditions or have violated the rights or legitimate interests of third parties. In such cases, “Diskret” Furniture has the right to provide the Client’s personal information to the relevant competent state authorities in accordance with applicable legislation.

3. Purposes for Which the Information May Be Used

3.1. “Diskret” Furniture collects and uses the information for the purposes set out in these General Terms and Conditions, as well as for offering new goods and/or services to the Client (free or paid), for offering goods and/or services provided by other parties, for promotions, for organizing raffles, inquiries, surveys, for adapting the provided services to the Client’s preferences, for statistical and other purposes.
3.2. By accepting these General Terms and Conditions, the Client consents to the processing of their personal data for direct marketing purposes. The Client has the right to object to the processing of their personal data for direct marketing purposes by sending a written notice to “Diskret” Furniture at the above-mentioned address or contact email address.
3.3. By accepting these General Terms and Conditions, the Client is considered informed within the meaning of Art. 34a, para. 1, item 3 of the Personal Data Protection Act that their personal data may be disclosed to third parties in compliance with applicable legislation or used on their behalf for direct marketing purposes, and may at any time object to such disclosure or use by sending a written notice to “Diskret” Furniture at the above-mentioned address or contact email address.

4. Disclosure of Information

“Diskret” Furniture undertakes not to disclose any personal information about the Client and not to provide the collected information to third parties – state authorities, companies, individuals, or others, except in cases where:

a. the explicit consent of the Client has been obtained at registration or at a later time, including under the conditions of 7.3.3 above;
b. the information is requested by state authorities or officials who, according to applicable legislation, are authorized to request and collect such information in compliance with legally established procedures;
c. in other cases provided by law.

5. Intellectual Property and Copyright

5.1. The intellectual property rights over all elements and resources located on the e-commerce website www.diskret-bg.com (including the available databases) are protected under the Copyright and Related Rights Act, belong to “Diskret” Furniture or the respective indicated person who has granted usage rights to “Diskret” Furniture, and cannot be used in violation of applicable legislation.
5.2. The Client’s right of access does not include the right to copy or reproduce information or to use objects of intellectual property, except in the case of an insignificant amount of information intended for personal use, provided that the legitimate interests of authors or other rights holders are not unjustifiably harmed and copying or reproduction is carried out for non-commercial purposes. Notwithstanding the above, the Client may not remove trademarks and other intellectual property rights notices from accessible resources, regardless of whether the rights holder is “Diskret” Furniture or a third party.
5.3. In cases of copying or reproducing information beyond what is permissible under the preceding paragraph, as well as in any other violation of intellectual property rights over the resources of “Diskret” Furniture, the Client owes “Diskret” Furniture a penalty of 2,000 (two thousand) BGN / 1,022.60 EUR for each individual violation. The specified penalty amount does not deprive “Diskret” Furniture of the right to claim compensation for damages exceeding the penalty amount.
